Contract Manager
Job Description:
Position Overview:
We are seeking an experienced Contracts Manager to lead and oversee all contractual and commercial aspects of major construction projects within the Klang Valley region. The role is positioned under a Project Management Consultancy (PMC) setup and involves managing the end-to-end contract process from pre-award activities through to post-contract administration, claims management, and project close-out.
The ideal candidate will have extensive experience in large-scale data centre, industrial, or high-technology building projects, and possess a deep understanding of contracts within the Malaysian construction environment.
Key Responsibilities:
1. Contract Administration & Management
- Oversee the preparation, review, negotiation, and administration of contracts and subcontracts in compliance with company policies and Malaysian regulations.
- Advise project teams on contractual rights, obligations, and risk exposure.
- Monitor contractor and consultant performance, ensuring alignment with contract deliverables and timelines.
- Ensure adherence to procurement and contract procedures in line with client and company standards.
2. Pre-Contract Stage
- Lead tendering and procurement processes, including preparation of tender documentation, commercial evaluations, and bid clarifications.
- Support cost planning and procurement strategy formulation during project inception.
- Participate in tender negotiations and recommendations for award.
- Conduct risk and opportunity assessments from a contractual perspective.
3. Post-Contract Stage
- Manage variations, change orders, and claims in line with contract provisions.
- Prepare, review, and negotiate claims for time and cost impacts; support dispute avoidance and resolution processes.
- Track project cost performance, payment certifications, and cash flow forecasts.
- Maintain accurate records of all contractual correspondences and changes.
4. Risk & Compliance
- Identify contractual and commercial risks and propose mitigation strategies.
- Ensure compliance with Malaysian law, company policies, and international contract standards.
- Liaise with legal counsel where required on complex contractual matters.
5. Stakeholder Management
- Work closely with clients, contractors, consultants, and internal project teams to ensure smooth communication and resolution of commercial issues.
- Support the Project Director in strategic decision-making regarding contract and commercial matters.
Key Requirements:
- Education: Bachelor’s Degree in Quantity Surveying, Civil Engineering, Construction Management, or Law.
- Professional Membership (Preferred): MRICS, MCIArb, or equivalent.
- Experience: Minimum 15 years of relevant experience in contract and commercial management, preferably under a PMC or client-side environment.
- Sector Experience: Strong background in data centre, industrial, or mission-critical projects is highly desirable.
- Contractual Knowledge: In-depth understanding of FIDIC, EPC, and Design & Build contract forms, with familiarity in local Malaysian construction contract practices (e.g., PAM, PWD).
