APPLICATION TERMS & CONDITIONS

1. Introduction
These Application Terms & Conditions (“Terms”) govern the submission of any application for employment to Windhoek Consulting Engineers, a professional Engineering Consultancy registered in Namibia (“the Company”). By submitting an application, you (“the Applicant”) agree to be bound by these Terms.

2. Accuracy and Legitimacy of Information
2.1. The Applicant warrants that all information submitted—including in the application form, CV, cover letter, references, and supporting documentation—is complete, accurate, and truthful.
2.2. Windhoek Consulting Engineers reserves the right to verify all submitted information. Any falsification or omission may result in disqualification, withdrawal of an offer, or termination of employment.

3. No Guarantee of Employment
3.1. Submission of an application does not imply or guarantee an interview, offer of employment, or future job consideration.
3.2. The Company reserves the right to suspend or terminate the recruitment process at any stage without providing reasons.

4. Use of Third-Party Platforms and Software
4.1. Windhoek Consulting Engineers may utilise third-party platforms, software, or service providers for applicant tracking, recruitment assessments, background checks, and candidate communications.
4.2. By submitting an application, the Applicant consents to their data being processed and stored by such authorised third parties, subject to appropriate data protection safeguards.

5. Confidentiality and Data Privacy
5.1. All personal data provided will be processed in accordance with applicable Namibian data protection laws and used strictly for recruitment purposes.
5.2. Applicant information may be retained for up to 12 months for future job consideration unless a written request for deletion is received.
5.3. Personal information may be shared internally within the Company or with approved recruitment consultants solely for the purposes of candidate evaluation.

6. Assessments and Testing
6.1. Applicants may be required to complete competency-based evaluations, technical assignments, online assessments, or psychometric testing.
6.2. Results and feedback from such evaluations remain confidential and are the property of the Company or its assessment partners.

7. Intellectual Property
7.1. Any reports, technical documents, presentations, or assignments submitted during the recruitment process as part of a task or test shall become the property of Windhoek Consulting Engineers, unless otherwise agreed in writing.
7.2. Submissions not requested by the Company are excluded from this clause.

8. Indemnity and Limitation of Liability
8.1. The Applicant agrees to indemnify and hold harmless Windhoek Consulting Engineers, its directors, staff, and agents from any claims, losses, or liabilities arising from:
a. False or misleading information submitted;
b. Breach of these Terms;
c. Any reliance on the recruitment outcome or perceived expectations.
8.2. The Company shall not be liable for any costs incurred by Applicants, including but not limited to travel, accommodation, relocation, or third-party expenses.

9. Withdrawal or Cancellation of Vacancies
The Company may, at its discretion, withdraw or cancel a job advertisement or vacancy at any time without prior notice and without liability.

10. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of Namibia. Any disputes arising shall be subject to the exclusive jurisdiction of Namibian courts.

11. Acceptance of Terms
By applying for a position at Windhoek Consulting Engineers, the Applicant confirms they have read, understood, and accepted these Terms in full.
