By submitting your application for the position indicated in the advertisement, you consent to the processing of your personal data by Varsofia (Registration No. 7011036703) based at 16 William Heerlein Lindley Street, 02-013 Warsaw, Poland for the purposes necessary for the recruitment process (in accordance with the Act of 10 May 2018 on the protection of personal data (Dz. Acts of 2018, item 1000) and in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (GDPR)).

You may withdraw your consent to the processing of personal data contained in your recruitment application for recruitment purposes at any time by sending such information using the form on our website www.varsofia.work/privacy-request. The withdrawal of your consent to process your personal data does not affect the lawfulness of the processing that Varsofia has carried out on the basis of the consent given before its withdrawal.

Personal data will be processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC ("GDPR") for the following purposes and on the following legal bases:

  1. in order to carry out the recruitment process in the scope of the personal data indicated in Article 221 § 1 of the Polish Labour Code or possibly in other relevant legal acts in the case of a desire to be employed on the basis of an employment contract - on the basis of Article 6(1)(c) of the GDPR (legal obligation) or - in the case of a desire to be employed on the basis of a civil law contract - on the basis of Article 6(1)(b) of the GDPR (taking action prior to concluding a contract);
  2. in order to carry out the recruitment process in respect of the non-compulsory (additional) personal data indicated by you in the recruitment application (including, inter alia, image, interests, etc.) - on the basis of Article 6(1)(a) GDPR (consent of the data subject);
  3. for the purposes of future recruitment processes (where prior consent has been given for future recruitment) - on the basis of Article 6(1)(a) GDPR (consent of the data subject);
  4. for the purpose of establishing, investigating, or defending against claims on the basis of Article 6(1)(f) GDPR (processing is necessary for the purposes of legitimate interests pursued by the controller or by a third party consisting in the defence of rights).

Provision of the personal data indicated in item 1 above is necessary in order to take part in the recruitment process, whereby in the case of a desire to be employed based on an employment contract, providing the data covered by Article 221 § 1 of the Labour Code (Poland) is a statutory requirement, and in the case of a desire to be employed based on a civil law contract - a condition for concluding the contract. Failure to provide the indicated personal data will make it impossible to participate in the recruitment process.

Other personal data included in the recruitment application is provided voluntarily and failure to provide it does not prevent you from taking part in the recruitment process. During the recruitment process, Varsofia also collects personal data contained in various documents, such as notes from the recruitment interview, references, documents authorising legal work, and information obtained in the course of recruitment. Failure to provide the personal data indicated may not be obligatory in some cases but may limit Varsofia's ability to consider your application.

Recipients of personal data
We may share your personal data with public authorities where we are obliged to do so under applicable law, recruitment management systems, IT service providers and information systems providers, as well as with our business partners and our clients in connection with the provision and supervision of the services we provide.

International transfer
As Varsofia, we need to share processes to ensure our efficiency and effectiveness. Accordingly, we transfer some personal data to countries, territories or organisations outside the European Economic Area. For transfers to territories not recognised as offering an adequate level of protection by the European Commission, we apply the standard data protection clauses adopted by the European Commission or other mechanisms for the transfer of personal data provided for by the RODO.

Storage of data
We will retain your personal data for as long as necessary for the purposes set out above, or as long as required by law. Your data will be deleted at the end of the recruitment process but no later than 24 months from the date of receipt of your application for employment unless you consent to its use in other recruitments. If you consent to the use of your data in other recruitments, they will be deleted no later than 60 months from the date of receipt of the employment application. In the case of processing based on your previously given consent - your data will be processed until you withdraw your consent. In the case of processing on the basis of Varsofia's legitimate interest - until the purpose of the processing is achieved or until an effective objection is made.
