The Head of Legal and Compliance is responsible for all legal and compliance matters in Thailand, with a strong focus on identifying and managing bribery/corruption risks relating to HCPs, GOs, and third party intermediaries.
Responsibilities:
Compliance:
- Lead and take ownership of the day-to-day operational administration, implementation, and localisation of the company's policies, standards, and controls relating to anti-bribery/corruption, trade sanctions, antitrust, and data privacy.
- Lead and supervise the Senior Compliance Executive to develop necessary compliance SOPs.
- Partner, advise and support country management team and internal stakeholders on the Compliance Programme.
- Develop stakeholder awareness and support of the Compliance Programme.
- Support, guide, supervise and review the Senior Compliance Executive's periodic reports / updates to the Country General Manager and Regional Compliance on the implementation and effectiveness of the Compliance Programme, local compliance risks, and risk management actions.
- Review the compliance reports / updates prepared by the Senior Compliance Executive.
- Periodically monitor, evaluate, and enhance the Compliance Programme.
- Consult with Head of Regional Compliance to resolve complex compliance issues.
- Monitor applicable laws, regulations, and industry developments relating to bribery / corruption, compliance and ethics.
- Plan, roll out, conduct and monitor the annual training program.
- Act as the Co-chairman of the Compliance Committee.
- Conduct investigations in relation to violations of the Compliance Programme.
- Supervise Compliance Manager to conduct compliance monitoring.
- Supervise Compliance Manager to conduct compliance risk assessments.
- Lead and coordinate with internal stakeholders to ensure closure of internal audit gaps.
- Represent the company in the Code Compliance Subcommitte in PReMA.
Legal: Advise, support and manage all local legal matters (including antitrust, personal data, and intellectual property).
Legal & Compliance: Provide legal and regulatory training to employees.
Qualifications & Competencies:
Mandatory:
- Bachelor's degree in law.
- Minimum 10 years' of experience in legal (law firm and/or in-house) and compliance.
- Strong analytical thinking and working knowledge of US FCPA, UK Bribery Act, and also Thai antibribery/corruption laws.
- Ability to collaborate cross-functionally to understand and resolve compliance issues and challenges.
- Strong communication (written and spoken) skills in Thai and English.
Preferably:
- Healthcare sector and compliance risk management experience in Thailand =
- Holds an internationally recognised compliance certification (e.g. CCEP-I).
- Strong working experience with compliance-related systems (e.g. third party risk management platforms).
