Referral Program Terms & Conditions

Company: The Offer Club LLC ("The Company")
1. Eligibility
Referrers: Open to individuals aged 18 or older who are legal residents of the United States. Internal employees of the hiring client and HR/hiring managers directly involved in the specific role are excluded from rewards.
Candidates: Referred candidates must not have applied to the specific client within the last 12 months and must not currently exist in The Offer Club’s active database for that specific client.
2. Referral Submission & Consent (CA Privacy Compliance)
In accordance with the California Consumer Privacy Act (CCPA) and the CPRA 2026 updates:
The Referrer warrants that they have obtained express verbal or written consent from the candidate before sharing their contact information.
The Company will provide the candidate with a "Notice at Collection" upon the first point of contact, identifying the Referrer as the source of the data.
3. Reward Structure & Payment
Successful Referral: A "Successful Referral" is defined as a candidate who is hired by the client and remains in good standing for a period of 90 calendar days (the "Guarantee Period").
Payment Timing: Referral bonuses are processed within 30 days following the successful completion of the Guarantee Period.
Bonus Amounts: Reward amounts vary by job requisition and will be confirmed in writing at the time of the referral submission.
4. Tax Obligations (1099-NEC)
Threshold: Per the One Big Beautiful Bill Act of 2025, the IRS reporting threshold for non-employee compensation is $2,000 for the 2026 tax year.
W-9 Requirement: Referrers who earn an aggregate of $2,000 or more in a calendar year must provide a completed IRS Form W-9 to The Offer Club LLC. The Company will issue a Form 1099-NEC for tax filing purposes. Referrers are responsible for all applicable local, state, and federal taxes.
5. California "Stay-or-Pay" & Mobility Compliance
In compliance with AB 692 (2026), referral rewards are considered a "discretionary bonus" for the referrer.
The Company does not utilize "stay-or-pay" provisions that require a referrer to return a paid bonus if the candidate's employment terminates after the 90-day Guarantee Period has been satisfied.
6. General Terms
Duplicate Referrals: If a candidate is referred by multiple people, the reward will be granted to the first person who submitted the referral via the official Manatal career portal or company email.
Modification: The Offer Club LLC reserves the right to modify or terminate this program at any time; however, any referrals submitted prior to a program change will be honored under the terms active at the time of submission.
