The Agreement

The headings of the clauses in this agreement are provided for convenience and ease of reference only and will not be used to interpret, modify or amplify any of the terms stipulated herein.

“Mpower” means the recruitment division specializing in the recruitment and placement of resources within affiliated companies of the Group.

“The Company” means any of affiliated companies of the Group as specified from time to time.

"User" means any person who enters or uses the Mpower website, which includes visiting or browsing the website

Mpower may amend any terms stipulated herein from time to time without prior notice to the User.

Website Terms of Use

The User may not in any way use any device, software or other instruments to interfere or attempt to interfere with the proper working of the website. In addition, the User agrees that the User will not in any way use any robot, spider, other automatic devices, or manual process to monitor, copy, distribute or modify the website or the information contained therein.

The User may not use the website to distribute material which is defamatory, offensive, contains or amounts to hate speech or is otherwise unlawful.

The User may not in any way display, publish, copy, print, post or otherwise use the website and/or the information contained therein without the express prior written consent of the Mpower.

The User clearly understands and agrees that the User bears full responsibility and carries all risks in respect of the use of whatsoever nature conducted on the website.

The User agrees that Mpower bears no responsibility and accepts no liability under any circumstances for any damages suffered or losses incurred from the use or misuse of the website.

The User is required to report any possible adverse situation, malfunctions or errors on the website, by informing Mpower by email on recruitment@mpower.careers.

The User may apply for specific opportunities on the Mpower website and/or upload his or her personal profile/resume as indicated on the website.

The User may complete the necessary information required to be registered on the database for potential opportunities that may arise.

The User is personally responsible for the maintenance of and/or updates of the User’s personal profile and /or any information uploaded on the Mpower website by the User.

Notwithstanding electronic and /or other communication from Mpower, the User is personally responsible for applying for advertised opportunities, failing which the application will not be considered for the position so advertised.

Should the User do anything that places Mpower at risk, Mpower may terminate the use of the website by the User or take such other steps that it may deem necessary in the particular circumstances.

Mpower may change the information on the Mpower website, including but not limited to the opportunities, products, services, or other offers mentioned, at any time without notice.

Terms and Conditions

The current version of the terms and conditions applicable at the time the User visits the website becomes binding each time the User visits the website. User’s must familiarise themselves with the current terms each time when using this website.

In the event that the User does not agree with any or all of the terms and conditions herein, the User must exit the website immediately, thereby indicating non-acceptance of the terms and conditions and the intention not to continue with the website in any manner whatsoever.

Should the User however proceed with the use of the website, such act will automatically be construed as an acceptance of all the terms and conditions, expressed and implied herein.

In exchange for the consideration of the User’s application, the User agrees that neither the submission and/or acceptance of the User’s application nor any subsequent engagement, either for the position applied for or any other purpose, and regardless of the contents of manuals, code of conduct, Company policies and procedures, benefit plans, policy statements, and the like as they may exist from time to time, or other Company practices, shall serve to create an actual or implied expectation of an offer of employment or any agreement.

The User authorizes the investigation of all statements contained in this application or any subsequent engagement.

The User understands that misrepresentation or omission of facts called for is cause for withdrawal and/or termination at any time without any prior notice.

The User hereby gives the Company permission to contact schools, colleges, universities, previous employers (unless otherwise indicated), references, and others, and hereby indemnifies the Company from any liability as a result of such contact or collection of information.

The User understands that in connection with the routine processing of the User’s application, the Company may request from a reporting agency an investigative report including information as to the User’s credit records, criminal records, character, general reputation, personal characteristics, and mode of living. Upon written request from the User, the Company, will provide the User with additional information concerning the nature and scope of any such report requested by the User.

The User hereby agrees that the rules in this paragraph will apply between the User and Mpower regarding the exchange, i.e. the sending and receiving of electronic messages via any electronic means, including via the website, its application forms and email.

• An automated or manual acknowledgement of receipt by Mpower of an electronic message shall not constitute a formal acceptance of any offer made by the User to Mpower or vice versa.
• An electronic message is deemed to have been sent by Mpower, at the time indicated on the electronic message as having been sent or, if not so indicated, at the time indicated on the Mpower computer system as having been sent.
• An electronic message is deemed to have been received by Mpower, once an authorised representative thereof confirmed receipt thereof or responded thereto, whichever is the earlier.

Disclaimer and limitation of liability

All information on the Mpower website is provided for the User's convenience and information purposes only. The information is not intended to constitute professional advice about the User's career or otherwise and the User is encouraged to obtain professional advice before taking any course of action related to information contained on the Mpower website.

Mpower provides no warranties in relation to the website or any information published on the website.

Mpower does not warrant that the User's application or subsequent engagement will be successful for the position.

Mpower provides no warranties in relation of any differences, amendments, inclusions and exclusions to the scope of work stipulated on the website to the actual job description or work scope.

Mpower provides no warranties that the website will be available at all times. The User hereby acknowledges that the website may be unavailable due to updates or other reasons beyond the reasonable control of Mpower from time to time.

Mpower shall not under any circumstances be held liable for any direct, indirect, special or consequential damages or any other damages whatsoever, whether in an action for breach of contract, delict, or otherwise, arising out of or in connection with the performance of or the use of, or inability to use the information available on the website. This includes, but is not limited to, the loss of data or loss of opportunities whether Mpower was advised or not of the damages and/or potential damages incurred.

Mpower’s decision is final in all instances and no correspondence will be entered into.

Mpower and affiliated companies of the Group reserves all its rights.
