CANDIDATE REPRESENTATION AGREEMENT | DRINKS NETWORK
This Candidate Representation Agreement (the "Agreement") is entered into on
on the day of applying for the role as advertising the agencies website (the "Effective Date"), between the applicant, hereinafter referred to as the "Candidate," and Drinks Network, a recruitment agency located at 6/251-255 Darlinghurst Road, NSW 2010 and online www.drinksnetwork.com.au, hereinafter referred to as the "Agency."
1. Agency Representation
1.1 The Candidate acknowledges that Drinks Network is a recruitment agency that specialises in connecting candidates with potential employers in the drinks industry.
1.2 The Candidate authorises Drinks Network to represent them to potential employers for job opportunities within the drinks industry, including but not limited to positions related to hospitality, sales, marketing, management, and other industry-specific roles.
2. Candidate's Obligations
2.1 The Candidate agrees to provide accurate and up-to-date information to Drinks Network, including details related to their qualifications, experience, work history, and job preferences.
2.2 The Candidate shall promptly inform Drinks Network of any changes in their job search status, including accepting or declining job offers presented by the Agency.
3. Exclusivity
3.1 The Candidate agrees to work exclusively with Drinks Network for a period of [Exclusivity Period], during which they will not seek employment opportunities through other recruitment agencies for positions in the drinks industry.
4. Payment Terms
4.1 The Candidate acknowledges that Drinks Network may charge a fee to the employer for their services. The Candidate is not responsible for any fees or costs associated with the recruitment process.
5. Job Offers
5.1 If the Candidate receives a job offer through Drinks Network, they agree to carefully review and consider the offer and to respond to the offer within a reasonable time frame.
5.2 The Candidate acknowledges that acceptance of a job offer through Drinks Network may result in a formal employment agreement with the employer. The terms and conditions of such agreements will be determined by the employer.
6. Termination
6.1 Either party may terminate this Agreement by providing written notice to the other party with 14 days' notice. Upon termination, the exclusivity clause shall no longer apply.
7. Dispute Resolution
7.1 In the event of a dispute arising from or relating to this Agreement, the parties agree to attempt to resolve the dispute through good-faith negotiations.
7.2 If negotiations do not lead to a resolution, the parties agree to participate in non-binding mediation conducted by a mutually agreed-upon mediator.
8. Governing Law
8.1 This Agreement shall be governed by and construed in accordance with the laws of New South Wales, without regard to its conflict of laws principles.
9. Entire Agreement
9.1 This Agreement constitutes the entire understanding and agreement between the parties with respect to the subject matter hereof and supersedes all prior negotiations, understandings, and agreements, whether oral or written.
10. User Agreement
By using entering your name, email and other details into our website www.drinsknetwork.com.au and sub agency websites, you are forming an agreement as a user of our website and as a candidate for the role you have applied for. This forms the agreement to which the candidate acknowledges forms the User Agreement.
