POPI POLICY RESOURCING DIVISION

INTRODUCTION

  1. DEARX SERVICES is obliged to comply with The Protection of Personal Information Act (‘POPI’).
  2. POPI requires DEARX SERVICES to inform candidates as to how their Personal Information is used, disclosed and destroyed.
  3. DEARX SERVICES guarantees its commitment to protecting candidates’ privacy and ensuring that their Personal Information is used appropriately, transparently, securely and in accordance with applicable laws.
  4. This Policy sets out how DEARX SERVICES deals with candidates’ Personal Information and, in addition, the purposes said information is used for. This Policy is made available on our websites and by request from our Resource Manager, whose details are provided in this document.
  5. Section 9 of POPI states that “Personal Information may only be processed if, given the purpose for which it is processed, it is adequate, relevant and not excessive.”

THE PERSONAL INFORMATION COLLECTED

  1. DEARX SERVICES collects and processes candidates Personal Information pertaining to candidates’ Professional Competence as potential employees of DeARX Services.

The type of information will depend on the need for which it is collected and will be processed for that purpose only. Whenever possible, we will inform candidates what information they are required to provide us with and what information is optional.

HOW PERSONAL INFORMATION IS USED

DISCLOSURE OF PERSONAL INFORMATION

  1. We may share candidates’ Personal Information and obtain information about candidates from third parties for the reasons already discussed in 3.1 and 3.2 above.
  2. We may also disclose candidates’ information where we have a duty or a right to disclose in terms of applicable legislation, the law or where it may be necessary to protect our rights.

SAFEGUARDING CANDIDATES INFORMATION

  1. It is a requirement of POPI to adequately protect the Personal Information we hold and to avoid unauthorised access and use of your Personal Information. We continuously review our security controls and processes to ensure that your Personal Information is secure.
  2. The following procedures are in place in order to protect your Personal Information:
    1. A third-party service provider is mandated to ensure the safeguarding of candidates’ Personal Information;
    2. Recommendations made by them are actioned.
    3. The DEARX SERVICES Resource Manager is Robyn Rondi, whose details are available below and who is responsible for the encouragement of compliance with the conditions of the lawful processing of Personal Information and other provisions of POPI;
    4. Employees are required to sign POPI Confidentiality Agreements which are considered annexures to their Employment Contracts;
    5. Archived candidate information is stored and governed by POPI
    6. Hard copy files are stored at secure premises and are destroyed after 3 years;
    7. DEARX SERVICES ’s internal server hard drives are protected by firewalls;
    8. Consent to process client information is obtained from candidates (or a person who is authorised by the client to provide the candidates’ Personal Information) during registration.

ACCESS AND CORRECTION OF PERSONAL INFORMATION

  1. Candidates have the right to request access to the Personal Information we hold about them.
  2. Candidates also have the right to ask us to update, correct or delete their Personal Information on reasonable grounds.
  3. Once a candidate objects to the processing of their Personal Information, DEARX SERVICES may no longer process said Personal Information.
