Partner - Construction Disputes
Job Description:
We are interested to speak with experienced and highly skilled Construction Disputes Partners with extensive experience in construction disputes, particularly in providing expert witness testimony regarding the quantum of loss due to delays and damages. The successful candidate will lead the firm's construction disputes practice, providing expert advisory services and contributing to the resolution of complex construction-related disputes for clients in the construction, engineering, and infrastructure sectors.

Key Responsibilities:
- Lead and manage construction disputes related to the quantum of loss, including delays, cost overruns, and damage assessments, providing expert advice to clients in the construction industry.
- Prepare and present expert witness reports and testimony in disputes concerning delays, cost claims, and damages, including providing analysis and evidence regarding the valuation of construction projects, contract disputes, and claims for extension of time or liquidated damages.
- Collaborate closely with legal teams, contractors, project managers, and engineers to assess and quantify losses, damages, and financial impacts resulting from delays, defects, and other construction-related issues.
- Conduct detailed cost analyses and prepare expert reports on matters such as project delays, disruption, acceleration claims, defective works, and related financial matters.
- Provide clients with advice on risk management strategies, helping them to mitigate the potential for construction disputes and to manage costs effectively during the course of construction projects.
- Manage and oversee complex construction disputes, including those that involve high-value claims and large-scale construction projects, advising clients on the technical and financial aspects of their disputes.
- Work closely with other construction industry experts, including lawyers, engineers, architects, and project managers, to provide comprehensive dispute resolution services.
- Stay updated on developments in the construction industry, including regulatory changes, industry standards, and best practices in cost management and dispute resolution.
- Drive business development efforts to grow the firms construction disputes practice, expanding the client base and building long-term relationships with stakeholders in the construction and infrastructure sectors.
- Represent the firm at industry events, seminars, and conferences, establishing thought leadership in the field of construction disputes and expert testimony.
Required Qualifications and Skills:
- Extensive experience (typically 10+ years) as a quantity surveyor with a strong background in construction disputes, particularly related to quantum of loss, delays, and damages.
- Proven experience as an expert witness in construction disputes, with a solid track record of preparing expert reports and providing testimony in litigation, arbitration, and adjudication settings.
- Deep understanding of construction contracts, including the ability to assess and analyze cost claims, delay claims, and the impact of construction defects on project costs.
- In-depth knowledge of industry-standard practices in project cost management, valuation of construction works, and quantification of delays and disruptions.
- Strong experience in preparing and presenting claims for extensions of time, liquidated damages, cost overruns, and project recovery.
- Expertise in the construction process, from project inception to completion, with experience in both public and private sector construction projects, including large infrastructure and commercial developments.
- Strong analytical skills with the ability to perform detailed cost analyses, review contracts and project documentation, and assess the financial impact of disputes.
- Excellent written and verbal communication skills, with the ability to produce clear and concise expert reports and communicate complex technical and financial issues effectively to both legal and non-legal stakeholders.
- Leadership and management experience, with the ability to manage a team of professionals and collaborate with other experts in the construction field.
- Ability to manage multiple, high-profile construction disputes and provide clients with actionable, timely advice.
Preferred Experience:
- Experience in handling disputes for major construction projects, including commercial buildings, infrastructure, residential developments, and government contracts.
- Background in construction project management or engineering, with a thorough understanding of the technical and practical aspects of construction work, particularly in relation to delays, disruptions, and damages.
- Familiarity with dispute resolution methods including arbitration, adjudication, mediation, and litigation, with an understanding of the legal processes involved in construction disputes.
- Knowledge of emerging trends in construction, such as sustainable building practices, energy-efficient technologies, and regulatory changes impacting the construction industry.
- Professional qualifications in quantity surveying, such as MRICS (Member of the Royal Institution of Chartered Surveyors), or other relevant industry certifications.
