Applicant Terms and Conditions

Welcome to B-Reach’s Applicant Tracking System (“System”). B-Reach is an HR and recruitment services company that supports various client organizations (“Clients”) by facilitating job applications. By accessing or using this System, you (“Applicant” or “you”) agree to be bound by these Terms. If you do not agree with these Terms, please do not use the System.

Important Notice:
Unless otherwise explicitly stated, B-Reach is not the employer. Instead, by submitting your application, you are expressing interest in employment opportunities with one or more of our Clients. Any employment relationship, if established, will be directly with the Client and subject to separate terms and conditions.

Scope of Agreement

• Acceptance: By using the System and submitting any information, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.
• No Employment Guarantee: Submitting an application through the System does not guarantee employment, an offer of employment, or any form of contractual relationship with either B-Reach or our Clients.
• Intermediary Role: You acknowledge that B-Reach is acting solely as an intermediary to assist you in connecting with potential employment opportunities with our Clients.

Applicant Representations and Obligations

• Accuracy of Information: You represent and warrant that all information provided in your application is true, accurate, and complete to the best of your knowledge. You agree to promptly update any information that becomes inaccurate or incomplete.
• Authorization: You confirm that you are legally authorized to work in the applicable jurisdiction and that you have all necessary rights and permissions to submit the information requested.
• Notification of Changes: Should you be offered employment by a Client, any discovery of inaccuracies or omissions in your application may result in the withdrawal of an offer or termination of the employment relationship with the Client.

Data Privacy and Use

• Consent to Data Processing: By submitting your application, you consent to the collection, storage, processing, and transfer of your personal data by B-Reach for recruitment purposes. This may include sharing your data with third parties (such as background screening providers or interview scheduling services) and our Clients to facilitate the recruitment process.
• International Data Transfers: As a global company, your personal data may be transferred to, stored, and processed in jurisdictions outside your country of residence—including but not limited to locations where our Clients or service providers are based. By using our System, you consent to such transfers.
• Privacy Policy: Please review our Privacy Policy for detailed information on how we collect, use, and safeguard your personal data.
• Data Retention: We will retain your personal data only as long as necessary for recruitment purposes and in accordance with our internal data retention policies and applicable laws.

Intellectual Property Rights

• Ownership: All content, designs, trademarks, and other intellectual property available through the System are the property of B-Reach or its licensors and are protected by applicable intellectual property laws.
• Limited License: You are granted a limited, non-exclusive, non-transferable license to access and use the System solely for the purpose of submitting your application. You may not copy, reproduce, modify, or create derivative works from any content provided without our express written permission.

System Use and Disclaimers

• “As Is” Basis: The System is provided on an “as is” and “as available” basis. B-Reach makes no warranties, express or implied, regarding the reliability, accuracy, or availability of the System.
• No Guarantee of Results: We do not guarantee that your use of the System will be uninterrupted, error-free, or secure from viruses or other harmful components.
• Limitation of Liability: To the fullest extent permitted by law, B-Reach shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the System or any information provided therein.
• Third-Party Disclaimers: B-Reach does not control and is not responsible for the recruitment practices or employment decisions made by our Clients. Any issues related to the application process, interviews, or employment terms should be addressed directly with the respective Client.

Modifications and Termination

• Amendments: We reserve the right to modify, update, or amend these Terms at any time without prior notice. Your continued use of the System after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
• Termination: We may, at our sole discretion, suspend or terminate your access to the System at any time and for any reason, including any breach of these Terms.

Governing Law and Dispute Resolution

• Governing Law: These Terms shall be governed by and construed in accordance with the laws of the relevant freezone area in Dubai, United Arab Emirates, or another jurisdiction as mutually agreed upon. In cases where local laws require otherwise, the mandatory provisions of such laws shall apply.
• Dispute Resolution: Any disputes arising from or relating to these Terms or your use of the System shall first be subject to negotiation between the parties. If an amicable resolution cannot be reached, the dispute shall be resolved through arbitration or in the courts of the specified jurisdiction, as agreed by the parties.

Miscellaneous

• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• Entire Agreement: These Terms constitute the entire agreement between you and B-Reach regarding your use of the System and supersede all prior understandings or agreements, whether written or oral.
