Terms and Conditions for Candidate Services:
1. Introduction
By engaging with ANZ Healthcare Staffing Pty Ltd ("ANZ Healthcare Staffing") for recruitment services, you ("the Candidate") agree to the following terms and conditions. These terms and conditions outline your responsibilities regarding the provision of accurate and legal documents before any payment for services is made.
2. Provision of Legal and Accurate Documents
(a) Accuracy and Legality: The Candidate must provide documents that are accurate, truthful, and legally obtained. This includes, but is not limited to, identification documents, educational certificates, professional qualifications, and employment records.
(b) Verification: All documents provided by the Candidate must be verifiable. The Candidate agrees to allow ANZ Healthcare Staffing to verify the authenticity of the documents through relevant authorities or institutions.
3. Candidate Responsibilities
(a) Timely Communication: The Candidate must maintain open and timely communication with ANZ Healthcare Staffing throughout the recruitment process.
(b) Compliance with Laws: The Candidate must adhere to all applicable laws, guidelines, and ethical norms of both the Commonwealth of Australia and the Candidate's country of citizenship during the recruitment process.
(c) Genuine Representation: The Candidate ensures that all qualifications, experiences, and skills presented during the recruitment process are genuine and verifiable.
4. Consequences of Providing Fraudulent Documents
(a) Fraudulent Documents: Should the Candidate knowingly submit, share, or otherwise provide fraudulent, inaccurate, or misrepresented documents, information, or other pertinent materials ("Fraudulent Documents") to ANZ Healthcare Staffing, the Candidate acknowledges and agrees that such actions shall result in: (i) A negative skills assessment. (ii) A two-year lock-out period for a new skills assessment. (b) Liability Disclaimer: ANZ Healthcare Staffing unequivocally disclaims all forms of responsibility and liability arising from, or in connection with, the use, reliance upon, or submission of such Fraudulent Documents during the provision of services. (c) Service Termination: ANZ Healthcare Staffing retains the right to terminate any ongoing services immediately upon the discovery of the provision of Fraudulent Documents by the Candidate, without incurring any liability or obligation to refund any fees paid. (d) Legal Actions: ANZ Healthcare Staffing reserves the right to take any additional actions as may be permitted under applicable law, including, but not limited to, reporting the incident to relevant authorities or regulatory bodies.
5. Indemnification
The Candidate hereby indemnifies, defends, and holds harmless ANZ Healthcare Staffing from and against all claims, damages, losses, penalties, fines, costs, and expenses, including reasonable attorneys’ fees, arising out of or in connection with the Candidate’s submission of Fraudulent Documents or breach of this agreement.
6. Payment for Services
(a) Invoice Submission: ANZ Healthcare Staffing will submit an invoice to the Candidate with due dates for payment. (b) Payment Terms: The Candidate must pay ANZ Healthcare Staffing the amount due in ANZ Healthcare Staffing's invoice within thirty (30) calendar days.
(c) Exclusivity of Disbursements and GST: The price payable by the Candidate to ANZ Healthcare Staffing for the provision of the services is exclusive of disbursements and GST unless otherwise stated.
By proceeding with ANZ Healthcare Staffing services, the Candidate acknowledges and agrees to these terms and conditions. These terms and conditions are effective immediately and remain in force throughout the engagement with ANZ Healthcare Staffing.
