EMPLOYMENT AGENCY CANDIDATE TERMS AND CONDITIONS
BACKGROUND
These Terms and Conditions set out the relationship between Affinity Care Recruitment (the "Agency") and individuals seeking employment (the "Candidate"). The Agency operates as an employment agency and aims to match suitable Candidates with Clients who have vacancies.
1. DEFINITIONS AND INTERPRETATION
1.1 In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:

"Agency" means Affinity Care Recruitment, a company registered in England and Wales under the name The Affinity Care Group, whose registered office is at [Your Office Address].

"Candidate" means any person using the Services for the purposes of finding employment.

"Client" means any person, firm, or company, including any associates or subsidiaries, to whom the Candidate may be introduced.

"Services" means the employment agency services provided by the Agency to the Candidate as set out in these Terms and Conditions.
1.2 Unless the context otherwise requires, each reference in these Terms and Conditions to:
1.2.1 "writing" includes communication by electronic means, including emails;
1.2.2 “these Terms and Conditions” refers to this document and any Schedules or amendments hereto;
1.2.3 a “Party” or the “Parties” refer to the Agency and the Candidate.
1.3 Headings are for convenience only and shall not affect the interpretation of these Terms and Conditions.

2. THE CONTRACT
2.1 All business entered into by the Agency is subject to these Terms and Conditions, and these terms shall prevail unless agreed otherwise in writing by a Director of the Agency.

2.2 The Candidate is deemed to have accepted these Terms and Conditions by submitting information or data to the Agency or applying for a position through the Agency.
2.3 The Agency may update these Terms and Conditions from time to time for legal or regulatory reasons and will notify Candidates of any significant changes.

3. THE SERVICES
3.1 The Agency offers Candidates the ability to browse vacancies and apply for roles suited to their skills and experience.
3.2 The Agency provides its Services at no cost to the Candidate.
3.3 The Agency endeavors to inform Candidates of suitable vacancies but does not guarantee that any vacancies will be available or that the Candidate will secure employment.

4. CANDIDATE INFORMATION
4.1 To use the Services, the Candidate shall be required to provide details such as their contact information, qualifications, training, experience, employment history, and references. The Agency uses this information to match Candidates with suitable vacancies.
4.2 The Candidate must ensure that all information provided is, to the best of their knowledge, accurate and up-to-date.
4.3 If any information changes, the Candidate must update the Agency as soon as possible.
4.4 Where the information provided includes details of a third party (e.g., referees), the Candidate must obtain consent before supplying these details to the Agency.
4.5 Consent for Reference Checks: The Candidate consents to the Agency contacting any referees provided to obtain references relevant to their employment history and suitability for roles.

5. APPLICATIONS
5.1 When applying for a vacancy, the Candidate must:
5.1.1 Read the full vacancy details;
5.1.2 Ensure they meet the requirements of the vacancy;
5.1.3 Possess any requisite qualifications and authorizations.

5.2 If any information provided to the Client is found to be incorrect or out-of-date, the Candidate must update the Client promptly.
5.3 The Agency will forward the Candidate’s details to Clients for the purpose of the specific vacancy only.

6. DATA PROTECTION
6.1 All personal data will be collected, processed, and held in accordance with the General Data Protection Regulation (GDPR). For further information, please refer to the Agency’s Privacy Policy.

7. LIABILITY
7.1 The Agency shall not be liable for:
7.1.1 Loss of any data, CVs, or other materials submitted by the Candidate;
7.1.2 The accuracy of information presented to Candidates;
7.1.3 The failure of the Candidate to secure employment with any of its Clients;
7.1.4 Any loss or damage caused by any Client.
7.2 The Agency’s liability shall not include business losses such as lost data, profits, or business interruption.

8. INDEMNITY
The Candidate shall indemnify the Agency against any costs, liability, damages, loss, claims, or proceedings that may arise from their use of the Services or submission of information.

9. FORCE MAJEURE
Neither Party shall be liable for any failure or delay in performing obligations due to causes beyond reasonable control, including, but not limited to, power failure, industrial action, civil unrest, or natural disasters.

10. NOTICES
10.1 All notices shall be in writing and delivered by courier, registered mail, or email.

11. RELATIONSHIP OF PARTIES
Nothing in these Terms and Conditions shall create a partnership, principal and agent, or employer and employee relationship between the Agency and the Candidate.

12. THIRD PARTIES
These Terms and Conditions are not enforceable by any third party under the Contracts (Rights of Third Parties) Act 1999.

13. SEVERANCE
If any provision of these Terms and Conditions is found to be unlawful, invalid, or otherwise unenforceable, that provision shall be deemed severed from the remainder.

14. MODIFICATION
The Agency may modify these Terms and Conditions at any time, with updates communicated via the website or email.

15. LAW AND JURISDICTION
15.1 These Terms and Conditions shall be governed by the laws of England and Wales.
15.2 Any disputes arising from these Terms and Conditions shall fall within the jurisdiction of the courts of England and Wales.
